Assange extradition case is heard by Supreme Court

Today Julian Assange is in court, defended by the seemingly very capable Dinah Rose QC.

On Twitter, follow the hashtag #jasup for a blow by blow account. The proceedings are being streamed live on: http://www.abc.net.au/news/livevideo/

All in all, Rose is banging away at the term “judicial” in “judicial authority”, with the main thrust of the argument being that the Swedish Prosecutor who issued the European Arrest Warrant (EAW) was NOT a judicial authority and therefore the EAW issued by the Swedish Prosecutor is not valid.

The main argument against the Swedish Prosecutor being a “judicial” authority stems from the requirement for the “judicial authority” to be independent. The argument goes that judge is considered to be independent, but a prosecutor is not.
